XF Terms of Use

1. INTRODUCTION
Welcome to XFun ("XF"). This Terms of Use Agreement (the "Agreement") is a legally binding contract between you ("User," "you," or "your") and XF ("the Company," "we," "us," or "our"). By creating an account, accessing the App, or using any services provided by XF (collectively, the "Service"), you acknowledge that you have read, understood, and agreed to be bound by every provision of this Agreement and our Privacy Policy.
Your access and use of our Services is also subject to the Privacy Policy, Community Guidelines, and Safety Tips, and any terms disclosed and agreed to by you when you purchase additional features or services from XF, which are incorporated into this Agreement by reference. If you do not wish to be bound by this Agreement, do not access or use our Services.
Changes to Terms: These terms may change from time to time. Notice of material changes will be posted on this page with an updated effective date. We may notify you of a change to the Terms via email, in-app notification, or other means; however, you are responsible for regularly checking this page for any changes. To the maximum extent permitted by applicable law, your continued access or use of our Services after the effective date of the Terms constitutes your consent to any changes, and as a result, you will be legally bound by the updated Terms. If you do not accept a change to the Terms, you must stop accessing or using our Services immediately.
Further, subject to applicable law, we reserve the right to change the availability of features in our subscription plans in any manner and at any time as we may determine in our sole discretion.
2. ACCOUNT ELIGIBILITY; YOUR RESPONSIBILITIES
Before you create an account on XF, make sure you are eligible to use our Services. This Section also details what you can and can't do when using the Services, as well as the rights you grant XF.
2a. Eligibility
You are not authorized to create an account or use the Services unless all of the following are true, and by using our Services, you represent and warrant that: You are an individual (i.e., not any body corporate, partnership or other business entity) at least 18 years old; you are legally qualified to enter a binding contract with XF; you are not prohibited by law from using our Services; you have not committed, been convicted of, or pled no contest to any crime involving violence, the threat of violence, or sexual misconduct; you are not required to register as a sex offender with any state, federal or local sex offender registry; you do not have any other active accounts on our Services; and you have not previously been banned from our Services, unless you have our express written permission to create a new account.
If at any time you cease to meet these requirements, all authorization to access our Services is automatically revoked, and you must immediately delete your account. We retain the right to delete your account and remove your access to our Services without warning in our sole discretion.
2b. Your Responsibilities
You agree to: comply with these Terms, and check this page from time to time to ensure you are aware of any changes; comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements; use the latest version of the App; treat other users in a courteous and respectful manner; be respectful when communicating with any of our customer care representatives or other employees; review the Safety Tips; review and comply with the Community Guidelines; and take reasonable measures to protect the security of your account and login information.
2c. Prohibited Conduct
You agree that you will not: misrepresent your identity, age, employment, qualifications or affiliations; use the Services in a way that damages the Services or prevents their use by other users; interfere with, disrupt or negatively affect the platform, servers, or networks; use our Services for harmful, illegal, or nefarious purposes (including money laundering or other financial crimes); harass, bully, stalk, intimidate, assault, defame or otherwise mistreat any person; post or share Prohibited Content; solicit passwords or personal identifying information for commercial or unlawful purposes; solicit money or other items of value from another user; use another user's account or share your account; engage in fraud, pyramid schemes, or similar practices; use our Services for political campaign financing or influencing elections (other than sharing personal political opinions); violate the license granted to you by XF; disclose private or proprietary information you do not have the right to disclose; copy, modify, distribute, or create derivative works from Member Content or Our Content without XF's prior written consent; imply endorsement by XF; use robots, crawlers, proxies, or other automated tools to access or reproduce our Services; upload viruses or malicious code; forge headers or manipulate identifiers; "frame" or "mirror" any part of our Services without authorization; use meta tags or code referencing XF to direct traffic elsewhere; modify, adapt, sublicense, reverse engineer, decompile or otherwise disassemble any portion of our Services; use third-party applications or services that directly interact with our Services without our written consent (including AI/ML systems); access or publish the XF API without our consent; probe, scan, or test vulnerabilities; encourage or promote activities that violate these Terms; create new accounts after suspension without permission; or submit false or manifestly unfounded reports. The license granted to you under these Terms and any authorization to access the Services is automatically revoked if you do any of the above.
2d. Prohibited Content
XF prohibits uploading or sharing content that: could reasonably be deemed offensive or to harass, upset, embarrass, or alarm any other person; is obscene, pornographic, violent, or contains nudity; is abusive, insulting, threatening, discriminatory or promotes hatred or bigotry; is illegal or encourages illegal activity (including terrorism, human trafficking, money muling, child abuse and exploitation); encourages or facilitates self-harm or dangerous activities; is defamatory or untrue; relates to commercial activities, solicitation, or advertising without authorization; involves transmission of junk mail or spam; contains spyware, adware, viruses or malicious code; infringes third-party rights; includes the image or likeness of another person without consent; includes images of minors without guardian consent; is inconsistent with intended use of the Services; or may harm XF's reputation. Uploading Prohibited Content may result in immediate suspension or termination of your account.
3. CONTENT
It is important that you understand your rights and responsibilities with regard to the content on our Services, including any content you provide or post. While using our Services, you may have access to: (i) content that you upload, provide, or share while using our Services ("Your Content"); (ii) content that other users upload or provide while using our Services ("Member Content"); and (iii) content that XF provides on and through our Services ("Our Content").
3a. YOUR CONTENT
You are responsible for Your Content. Don't share anything that you wouldn't want others to see, that would violate this Agreement, or that may expose you or us to legal liability. You are solely responsible and liable for Your Content, and you agree to indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content. You represent and warrant that the information you provide is accurate and that you will update your account information as necessary.
3b. OUR CONTENT
XF owns or licenses all other content on our Services. All rights, title, and interest in and to Our Content remains with us at all times.
4. INAPPROPRIATE CONTENT AND MISCONDUCT; REPORTING
XF does not tolerate inappropriate content or behavior on our Services. We are committed to maintaining a positive and respectful community, and we encourage you to report any inappropriate content or misconduct by other users. You can report or block a user via the in-app reporting features or by contacting Customer Support. Violations may result in warnings, suspension, or permanent bans depending on severity. Manifestly unfounded reports may result in enforcement actions against the reporter. More information on appeals is available in the app.
5. PRIVACY
For information about how XF collects, uses, and shares your personal data, please read our Privacy Policy. By using our Services, you agree that we may use your personal data in accordance with our Privacy Policy.
6. RIGHTS YOU ARE GRANTED BY XF
XF grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Services for their intended purpose so long as you comply with these Terms. This license is automatically revoked if you fail to comply with these Terms.
7. YOUR RIGHTS GRANTED TO XF
You own the content you provide, but by using XF you grant us a worldwide, perpetual, transferable, sublicensable, royalty-free license to host, use, copy, display, adapt, publish, or share your content in any format, including for AI training and service improvements. This license is non-exclusive, except for derivative works we create using your content, which may be exclusive. We may access or disclose your content and account information when required by law, to enforce terms, handle requests, protect rights, or prevent fraud.
8. PURCHASES & SUBSCRIPTIONS
All purchases, including subscriptions, are charged through your chosen payment method—either in-app or via an external service (like Apple ID or Google Play). Subscriptions auto-renew until you cancel. By purchasing, you agree to pay the displayed price plus any taxes and authorize XF to charge your payment method. Refunds or reversed payments may lead XF to terminate your account immediately. To cancel, manage your subscription in the app, website, or your external account. You can keep using the service until the end of your current period. Updating payment info is available in Settings. XF may receive updated card info from your issuer, and billing dates may change. Some users may be eligible for refunds. If you subscribed using your Apple ID, refunds are handled by Apple.
9. PAYMENT AGREEMENT
We have 3 subscription options on VIP membership service. Your iTunes account will be charged at confirmation of your purchase. Here are the options:
1. 1 month auto renewal VIP membership service with the price $29.99.
2. 3 months auto renewal VIP membership service with the price $59.99.
3. 6 months auto renewal VIP membership service with the price $99.99.
Please note that with all subscriptions: Prices are in U.S. dollars, may vary in countries other than the U.S. and are subject to change without notice. Please be aware that there is no cancellation of the current subscription allowed during an active subscription period. Payment will be charged to iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal. Subscriptions may be managed by you and auto-renewal may be turned off by going to the user's Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
10. ACCOUNT TERMINATION
You can delete your account anytime via Settings. Subscriptions purchased through third parties (Apple, Google) must be canceled there to stop billing. XF may suspend or terminate accounts if you violate these Terms or act inappropriately. No refunds are required. Account data will be handled per our Privacy Policy.
11. ADS & THIRD-PARTY CONTENT
Service is for personal use only, not for advertising, solicitation, or business purposes. Our Services may include ads or links to third-party content. XF does not endorse or guarantee these. Your interactions with third parties are governed by their terms, not XF’s.
12. ACCEPTANCE
Using XF means you accept these Terms, Privacy Policy, Cookie Policy, Community Guidelines, and any purchase terms. Do not use the Services if you disagree.
13. ENTIRE AGREEMENT
These Terms and referenced policies are the full agreement. Invalid provisions do not affect the rest. You may not assign your account; we may assign our rights. No agency, partnership, or employment is created.
14. DISCLAIMER
Please be acknowledged that XF is only available in Google Play and App Store for mobiles only. We do not have any PC website or application. XF does not accept any liability for any damage caused by other third party. Our official website is www.xpalapp.com.
